For months now, we have been letting everyone know that banks were going to begin shifting their focus when liquidating distressed properties. They would start supporting short sales over foreclosures. There is no longer any doubt this is now the new normal.

In a recent news release, the FHFA announced new guidelines to streamline the short sale process.

FHFA Acting Director Edward J. DeMarco on the new guidelines:

?These new guidelines demonstrate FHFA?s and Fannie Mae?s and Freddie Mac?s commitment to enhancing and streamlining processes to avoid foreclosure and stabilize communities.?

Most Americans Confused By Cloud Computing According to ...

While ?the cloud? may be the tech buzzword of the year, many Americans remain foggy about what the cloud really is and how it works. A new national survey by Wakefield Research, commissioned by Citrix, showed that most respondents believe the cloud is related to weather, while some referred to pillows, drugs and toilet paper. Those in the know claim working from home in their ?birthday suit? is the cloud?s greatest advantage. The good news is that even those that don?t know exactly what the cloud is recognize its economic benefits and think the cloud is a catalyst for small business growth.

The survey of more than 1,000 American adults was conducted in August 2012 by Wakefield Research and shows that while the cloud is widely used, it is still misunderstood. For example, 51 percent of respondents, including a majority of Millennials, believe stormy weather can interfere with cloud computing. Nearly one third see the cloud as a thing of the future, yet 97 percent are actually using cloud services today via online shopping, banking, social networking and file sharing. Despite this confusion, three in five (59 percent) believe the ?workplace of the future? will exist entirely in the cloud, which indicates people feel it?s time to figure out the cloud or risk being left behind in their professional lives.

These survey responses show there is a significant disconnect between what Americans know, what they pretend to know, and what they actually do when it comes to cloud computing. Among the key findings:

People feign knowledge about the cloud: One in five Americans (22 percent) admit that they?ve pretended to know what the cloud is or how it works. Some of the false claims take place during work hours, with one third of these respondents faking an understanding of the cloud in the office and another 14 percent doing so during a job interview. Interestingly, an additional 17 percent have pretended to know what the cloud was during a first date. Younger Americans are most likely to pretend to know what the cloud is and how it works (36 percent ages 18-29, 18% ages 30 and older), as are Americans in the West (28 percent West, 22 percent U.S.)

You?re not alone: While many admit they don?t understand the cloud, 56 percent of respondents say they think other people refer to cloud computing in conversation when they really don?t know what they are talking about.

What is it, anyway?: When asked what ?the cloud? is, a majority responded it?s either an actual cloud (specifically a ?fluffy white thing?), the sky or something related to the weather (29 percent). Only 16 percent said they think of a computer network to store, access and share data from Internet-connected devices. Some of the other verbatim responses include:

  • Toilet paper, pillow, smoke, outerspace, cyberspace, mysterious network, unreliable, security, sadness, relaxed, overused, oh goody a hacker?s dream, storage, movies, money, memory, back-up, joy, innovation, drugs, heaven and a place to meet.

Many use it, few understand it: A majority of Americans (54 percent) claim to never use cloud computing. However, 95 percent of this group actually does use the cloud. Specifically, 65 percent bank online, 63 percent shop online, 58 percent use social networking sites such as Facebook or Twitter, 45 percent have played online games, 29 percent store photos online, 22 percent store music or videos online, and 19 percent use online file-sharing. All of these services are cloud based. Even when people don?t think they?re using the cloud, they really are.

Can the cloud save the economy?: Even though many Americans don?t know exactly what the cloud does, they see its silver lining. Most Americans (68 percent) recognize the economic benefits after learning more about the cloud. The most recognized benefits are that the cloud helps consumers by lowering costs (35 percent), spurs small business growth (32 percent) and boosts customer engagement for businesses (35 percent). Millennials are most likely to believe that the cloud generates jobs (26 percent Millennials, 19 percent Boomers).

Softer advantages, like working from home in the buff: People offered additional, unexpected benefits of the cloud, including the ability to access work information from home in their ?birthday suit? (40 percent); tanning on the beach and accessing computer files at the same time (33 percent); keeping embarrassing videos off of their personal hard drive (25 percent); and sharing information with people they?d rather not interact with in person (35 percent).

Concerns include cost, security, privacy: Despite these advantages, Americans still have reasons why they limit their use of cloud computing or avoid it entirely. Among those who hardly ever or never use the cloud, the top three deterrents are cost (34 percent), security concerns (32 percent) and privacy concerns (31 percent).

?This survey clearly shows that the cloud phenomenon is taking root in our mainstream culture, yet there is still a wide gap between the perceptions and realities of cloud computing,? said Kim DeCarlis, vice president of corporate marketing at Citrix. ?While significant market changes like this take time, the transition from the PC era to the cloud era is happening at a remarkable pace. The most important takeaway from this survey is that the cloud is viewed favorably by the majority of Americans, and when people learn more about the cloud they understand it can vastly improve the balance between their work and personal lives.?

Methodological Notes:

The Citrix Cloud Survey was conducted by Wakefield Research (www.wakefieldresearch.com) among 1,006 nationally representative American adults ages 18 and older, between Aug. 2-7, 2012, using an email invitation and an online survey. Quotas have been set to ensure reliable and accurate representation of the U.S. adult population 18 and older.

Results of any sample are subject to sampling variation. The magnitude of the variation is measurable and is affected by the number of interviews and the level of the percentages expressing the results. For the interviews conducted in this particular study, the chances are 95 in 100 that a survey result does not vary, plus or minus, by more than 3.1 percentage points from the result that would be obtained if interviews had been conducted with all persons in the universe represented by the sample.

The National Law Journal and the ABA Journal report on a story out of Boston of how a former big law associate, already suing the firm for racial discrimination and retaliation, was allowed to add on charges of defamation and invasion of privacy. The additional charges stem from the alleged disclosure of an EEOC final determination letter to a law blog, Above The Law. The letter contained damaging information about the ex-employee, which the ex-employee claims was supposed to have remained private.

There were two troubling employment practices aspects to the story: first, the possibility that someone at the firm could be responsible for disclosing the EEOC letter and second, a statement made by a firm spokesperson to Above The Law. Those types of actions lend themselves to potential new, costly, and unnecessary legal claims. While there may be defenses to the new claims, I would rather direct the discussion to business practices that limit such claims in the first place.

Defamation & Invasion of Privacy For Distributing The EEOC Letter

It?s unclear how Above The Law received a copy of the EEOC letter. The ex-employee claims that the agency is not supposed to make such materials available to the public until there is a legal proceeding, which did not happen until over two months after the blog?s publication. Therefore, he alleges that the firm must have disclosed the letter, because he certainly did not.

If a Wisconsin employer released a similar letter outside the organization, the disclosure would have the potential for a defamation and invasion of privacy claim. In Zinda v. Louisiana Pacific Corp., decided by the Wisconsin Supreme Court, an employee was terminated because the company claimed he had falsified his employment application. In a newsletter, the company informed other employees of the termination and the reason. The newsletter did not stay just inside the company and two of Zinda?s acquaintances read it. Consequently, Zinda felt embarrassed and humiliated and he filed additional complaints for defamation and invasion of privacy.

The case was a lengthy litigation for the company. A jury awarded Zinda $50,000 in compensatory damages and $50,000 in punitive damages. The employer then appealed, claiming the damages were excessive and that a conditional privilege existed that allowed the publication. The Court of Appeals upheld the defamation and invasion of privacy claims, but directed a new trial on the amount of damages. Both parties then appealed to the Wisconsin Supreme Court, which said that while there is a conditional privilege for communicating personnel matters within a company, that privilege can be lost if abused. Further, it is up to a jury to decide whether the privilege has been abused.

In hindsight, were two jury trials, $100,000 in potential liability, two appeals, and the associated litigation costs worth it to identify Zinda as an employee who had been terminated for falsifying an employment application? Wouldn?t the? better business decision have been for the company to not say anything? If it was important to communicate to other employees that honesty was expected and termination was a very real possibility, could the company not have done so without identifying and embarrassing the individual?

Circling back to the current case and the EEOC letter, again, we will have to wait and see how the EEOC letter was obtained by Above the Law. If the blog obtained the letter from someone outside the law firm, then the firm did not invite further litigation. But if an insider released the letter, then the firm did invite further litigation and the costs and publicity that go with it.

Unnecessary Statements

The other troubling aspect of the Above The Law story is the following statement made by a spokesperson at the firm:

?After an 18-month investigation, the EEOC determined that [we] denied partnership to [the ex-employee] because of work that was well below our partnership standards, his fractured relationships with colleagues and allegations of inappropriate behavior with subordinates. In short, he did not perform to the high standards of quality and judgment expected of partners at our firm, and as a result we terminated his employment.? (Emphasis added).

I understand that the firm probably felt the need to defend itself and provide its perspective. But the response could have been limited to, ?as you can see, the EEOC determined that we did nothing wrong. We look forward to moving past this issue.?? That would have been a simple response, one that communicated the key facts and agency determination that the firm did nothing wrong, without giving the ex-employee a reason to feel insulted or further humiliated. Instead, the spokesperson?s comments serve as a permanent negative reference against the ex-employee and could result in questions into allegations that were never proven or not generally known. Such damaging consequences are key ingredients for inviting a litigious response in the form of defamation or invasion of privacy.

Keep It Simple

When discussing an ex-employee ? whether speaking to the media, company employees, or to future employers ? keep the conversation as simple as possible. A former employee who feels publicly humiliated or embarrassed will look for litigation as a means to strike back or to recover damages. Rather than invite unneeded litigation, keep the following points in mind:

1.? If the person?s identity or wrongful actions are not known, do not be eager to publicize them.

2. If the person?s identity is known, just acknowledge that the person was terminated without discussing the details or reasons for the termination.

3.? Be aware that comments to the media or a blog will be public and may haunt the person?s job search or career for a long time.

4.? Avoid comments that will put the person in the awkward position of defending unproven allegations of inappropriate or illegal behavior.

TAMPA--When the three major news networks announced last week that they would not air Ann Romney's Republican National Convention Monday night speech in Tampa, Republicans started scrambling. Romney's likeable wife of 43 years needed a primetime spot, they decided, and party leaders were reportedly ready to bump the popular Florida Sen. Marco Rubio to make that happen. Eventually, they moved New Mexico Gov. Susana Martinez's appearance to another night so that Ann could steal the spotlight on Tuesday. Meanwhile, party officials denied they had ever considered dumping Rubio.

This last minute jockeying is a testament to just how vital the campaign considers Ann to her husband's election efforts, something that wasn't always the case over the course of Romney's political career. Back in 1994, during Romney's failed U.S. Senate bid (and first run for office), the new political spouse on the block was a gaffe-prone potential liability without the polish or PR skills to handle the press. But over the years, Ann has learned how to spin family tales into political catnip--wooing voters by offering a dimension to her husband that no one else has seen before?and becoming a smooth and competent politician in her own right.

The 63-year-old mother of five and grandmother to 18 has emerged as an important humanizing force for Romney on the campaign trail. While the presumptive Republican nominee can come across as stiff and awkward on the stump, Ann charms the crowd with personal stories, casting her husband in a softer light. At a rally in Michigan on Friday she choked up while expressing gratitude that so many supporters in her home state had shown up. "Mitt and I grew up here, we fell in love here, and this is a special place for us," she said.

Despite her ongoing struggle with multiple sclerosis, which she was diagnosed with in 1998, Ann has attended hundreds of campaign events and often comes across as having more energy on the stump than her husband. She was at her husband's side at virtually every rally during the long primary?working the rope line alongside her spouse and often delivering a mini stump speech of her own.

In one instance, she tells the story of being a stay-at-home mom in charge of five "very naughty" sons when her husband, then a consultant with Bain Capital, was traveling. "He would call home, and he'd hear a very exasperated wife at the end of the phone," Ann said during a rally in South Carolina in January. "And he'd remind me to hang in there. It would be okay, that actually my job was more important than his job. And the cool thing was he meant it."

"You couldn't pay me to do this again"

Ann now seems so skilled and smooth in interviews it's hard to believe that she is actually something of a comeback kid, politically speaking.

During her husband's unsuccessful bid for a Massachusetts Senate seat, the Boston Globe blasted her in a scorched-earth profile that portrayed her as a chatty, over-privileged woman living a life so perfect it bordered on creepy. The two lines from the interview that most haunted the campaign: Ann's insistence that she and her Ken-doll-looking husband had never once had a fight during their marriage; and her statement that the couple was "struggling" when Mitt was getting his graduate degrees at Harvard. The two were supporting themselves by selling off American Motors stock given to Mitt by his wealthy father?something that didn't exactly resonate with voters working two jobs to survive. ("Mitt was still in school and we had no income except the stock we were chipping away at. We were living on the edge, not entertaining. No, I did not work. Mitt thought it was important for me to stay home with the children, and I was delighted," she said at the time.)

In an article titled "Daughter of Privilege Knows Little of Real World," the Boston Herald ripped off the most unflattering of the Globe's quotes. The experience left Ann incredibly angry, she later admitted. When a reporter asked her after her husband's defeat whether she would ever help him launch another race, she retorted: "Never. You couldn't pay me to do this again."

Writer Ron Scott, a Mormon who wrote MITT ROMNEY: An Inside Look at the Man and His Politics and who lived in the same stake?sort of the Mormon version of a diocese?as the Romneys, said he remembers "gasping" when he first read the Globe profile, instantly recognizing it as a disaster. But now, Scott thinks the incident just shows how fully Romney trusted his wife?for good or for bad. Despite her political inexperience, her husband was willing to let Ann do an hour-long one-on-one interview without media training or a PR team to hold her hand. And Ann was happy to take that risk, confident she could come out on top.

Perhaps that assurance was misplaced at the time, but it seems fitting now.

"She looks...like she's enjoying the campaign," Scott said. "I think if you were to contrast between now and '94, I don't think she really enjoyed that campaign or the 2008 one, but this time around I think she really looks like she's come alive."

The happy homemaker

Romney often introduces Ann as his "sweetheart" on the trail. The two began dating when she was 16 and he 18 in the ritzy Detroit suburb of Bloomfield Hills. Ann's father, an immigrant from Wales, had made his fortune and served as the town's mayor. Romney, the son of Michigan Gov. George Romney, "hotly pursued" her, she said later. After a year at Stanford and two years of a Mormon mission in France, Romney rushed home and proposed to Ann, who had converted to Mormonism under Gov. Romney's tutelage and was attending Brigham Young University in Utah.

Ann eventually finished her undergraduate degree in French in 1975, when she already had two children. She recalled in an interview with People magazine that she shocked a professor at Harvard's extension school--where she took some classes at night while Mitt attended grad school--for needing to nurse one of her children in the back of the lecture hall. "It's one of those things where the professor is like, 'Wait, wait, wait, this is liberal Harvard, but what am I going to do about that woman in the back with a baby that's nursing?' He just kept pretending like I wasn't there," she recalled. Though she saw the Beatles perform live in Detroit and was a child of the 60s, Ann was a bit of rebel in reverse for wanting to settle down and have children instead of pursuing a career. She's said she felt judged sometimes by peers, but never regretted her decision.

During the campaign in April, she used a Democratic strategist's attack on her for never "working a day in her life" to portray Democrats as judgmental and dismissive of mothers, a powerful counterattack to the Democratic argument that Republicans were waging a "war on women." The comments sent Democrats into a tailspin, with no less than President Barack Obama himself going on TV to say, "There's no tougher job than being a mom" within a day of the comments. Ann later called the attack "an early birthday gift" in comments that were captured by a hot mic, inadvertently showing off her tough-as-nails political instincts.

Team Romney

When speaking about Romney's bid, Ann frequently uses the "we" or the "Mitt and I" construction, emphasizing just how invested in the campaign she actually is. She's not just selling Mitt on the stump--she's selling them both as a team.

"Mitt and I are in an unusual position right now to make a difference to the future of this nation," she told a rally in West Charleston, S.C., in January.

Then, two weeks ago, she said to NBC: "I don't think he could do it without me. I don't believe he could."

Her willingness to take on the mantle of surrogate is somewhat surprising for a woman who has often aired her misgivings about opening up her private life and whom the Boston Globe described as largely "invisible" in Massachusetts as first lady when her husband was governor. Even now, when traveling on her own, Ann rarely tells people she meets on planes her true identity; she prefers to say vaguely that she works in public relations.

Technically, she's not lying. During the primaries, when Romney had a tense relationship with his traveling press corps, Ann would venture back on the candidate's plane to chat with reporters?offering up a friendlier face to the pack of wolves press than her hunted husband.

After a disastrous event in South Carolina when Romney was photographed with one of the smallest crowds he's ever attracted on the trail, Ann wandered off the bus and stood with reporters awaiting a gaggle with the candidate.

"What kind of jeans are you wearing?" she jokingly shouted, as her husband took the mic?a reference to a brief media obsession over whether the candidate was sporting "skinny" jeans on the campaign trail. Her husband grinned.

On the campaign plane, Ann always shares a row with her husband. He reads his iPad, while she's been spotted flipping through issues of US Weekly. He has said her presence keeps him calm. "If I'm away from Ann for longer than a week or so, I get off course," Romney told CNN's Piers Morgan. "She has to bring me back and moderate me down a bit."

But Ann's sunny disposition has faltered as negative attacks on her family's wealth and character intensified over the summer. While she's continued to be one of her husband's strongest assets on the stage, Ann has largely ceased her plane-side chats with reporters trailing her husband across the country.

Advisers who declined to be named discussing the candidate's wife said Ann was deeply wounded by the British tabloid attacks in July over her husband's comments suggesting he found London's Olympic preparations "disconcerting." (The Sun tabloid called him "Mitt the Twit" in retaliation, and the gaffe threatened to overshadow Romney's foreign tour.)

More recently, her hackles have been up over demands that her husband release more years of his tax returns. Ann was noticeably agitated in an interview with NBC's Natalie Morales two weeks ago when asked about the financial disclosures.

"Have you seen how we are attacked? Have you seen what's happened?" she said, leaning forward in her chair. "We have been very transparent to what's legally required of us. But the more we release, the more we get attacked, the more we get questioned, the more we get pushed. And so we have done what's legally required, and there's going to be no more tax releases given."

Besides fighting back in interviews, Ann has grown more aggressive on the stump as well. The announcement of Rep. Paul Ryan (R-Wisc) as Romney's running mate has breathed new life into the campaign, drawing larger crowds to Romney's events. Joining her husband and Ryan on stage at a rally in Mooresville, N.C., earlier this month, she marveled at the size of the crowd that had turned out, which was estimated to be at least 4,000 people.

"They know America is in trouble and these are the guys who are going to save it," she said. "It's a boost that gives us determination to say we're not going to take it anymore! We're going to take the White House back!"

AAP Issues New Guidelines for Kids' Snoring

A new set of practice guidelines released Monday by the American Academy of Pediatrics (AAP) may help parents and pediatricians uncover things that go snore in the night.

Pediatric sleep experts focused on children with a condition known as uncomplicated obstructive sleep apnea, which occurs when breathing is interrupted during sleep and is related to enlarged tonsils or obesity.? It is a condition the AAP says affects 1.2 to 5.7 percent of American children. They reviewed evidence from 350 study articles between 1999 and 2010 to create the following recommendations:

  • Screening: All children and adolescents should be screened for snoring at their routine health visits.
  • Sleep testing: Any children who have symptoms of obstructive sleep apnea, such as habitual snoring, disturbed sleep from intermittent pauses, snorts or gasps, or daytime behavioral problems, should be referred for a sleep study.
  • Adenotonsillectomy: Any child with obstructive sleep apnea and enlarged tonsils should be referred to a surgeon to consider tonsil removal surgery.
  • High risk: A child undergoing tonsil surgery is considered ?high-risk? if he or she is under age 3, has severe sleep apnea on sleep testing, is obese or currently has an infection. These children should be closely monitored in the hospital after surgery?for any complications.
  • Re-evaluation: After surgery, snoring children should be reassessed to see if their sleep apnea has improved or if they will need any further treatments.
  • CPAP: If symptoms do not improve after surgery or if a child is unable to get surgery for some reason, they should be considered for CPAP (continuous positive airway pressure), which is a breathing apparatus, often worn at night, that keeps airways open.
  • Weight loss: Weight loss is recommended for any overweight or obese patient in addition to any other treatments.
  • Intranasal steroids: Nasal sprays are recommended for patients with mild sleep apnea symptoms, whether in lieu of or after tonsil surgery.

The last set of guidelines for pediatric sleep apnea was released in 2002. The changes reflected in these new guidelines were made in light of research over the past 10 years that has suggested that delayed diagnosis of childhood sleep apnea ?can result in severe complications if left untreated,? according to the American Academy of Pediatrics report. Examples include cognitive deficits, behavior problems, hypertension and heart problems, failure to thrive and inflammation throughout the body.

With these new guidelines, the AAP hopes that more cases of childhood sleep apnea will be diagnosed sooner and children will receive the proper treatments earlier to prevent these dangerous long-term effects.

?These new guidelines are extremely important,? says Dr. Vikas Jain, a sleep specialist at Integris Health in Oklahoma City.

?Pediatric sleep apnea is a rising problem among American children and leads to serious consequences,? he says. ?The sooner we can diagnose a child with this condition, the sooner we can get these kids started on the right treatments to improve their quality of life and their overall health.?

Gonorrhea and chlamydia are attacking the younger people while syphilis is attacking the older ones. People who are age 30 and older are accounting for approximately 73 per cent of all the reported syphilis cases in 2010. Huffington Post reports that, "Syphilis is a bacterial STD that initially manifests itself in sores or sometimes presents no symptoms. If the infection isn't treated immediately, people who have syphilis can go on to suffer rashes and lesions, hair loss and flu-like symptoms like muscle aches, fevers, sore throats and fatigue. Without treatment, syphilis could last for years and go on to damage internal organs and cause stillbirths. If caught early, the infection is easily treated with antibiotics such as penicillin."

The latest episode came when police say a man disgruntled over losing his job a year ago shot a former colleague to death and pointed his weapon at two police officers in the shadow of a major tourist attraction.

He apparently wasn't able to fire before police killed him, one firing off seven rounds and the other nine. Bystanders suffered graze wounds, and some were struck by concrete gouged from buildings by the bullets, authorities said. At least one person said he was actually hit by a bullet.

Robert Asika, a 23-year-old tour guide who was hit in the right arm, said he was "100 percent positive" he was shot by a police officer.

A witness told police that laid-off clothing designer Jeffrey Johnson fired at officers, but ballistics evidence so far contradicts that, authorities said.

Police released dramatic surveillance footage later Friday. The video shows a calm scene with people milling about on the street. Johnson comes into view walking quickly down the street, followed by two police officers. He stops, wheels around and points a gun directly at the officers. The officers fire at Johnson and he quickly falls to the ground. The video shows nearly a dozen bystanders running, including a little boy and girl who were just feet away from Johnson.

During any shooting involving police, the officers who fired their weapons are first interviewed by prosecutors to determine whether anything criminal took place. The officers are placed on desk duty while the probe is completed, and if no criminality is determined, they are interviewed by the department's internal affairs arm.

Meanwhile, police will try to account for every shot fired, every shard of concrete sprayed and every bullet fragment by interviewing witnesses and doing ballistics reports at the scene. Johnson was hit at least seven times, chief spokesman Paul Browne said.

If bullets fired by police or fragments struck civilians, then the officers were also lucky to be alive, since bullets could have boomeranged in their direction, said Eugene O'Donnell, a professor of police studies at the John Jay College of Criminal Justice.

O'Donnell, a former police officer and police trainer, said the shooting officers found themselves in a situation that police dread ? because of the danger that bullets can ricochet in crowded settings.

"Picture 50 terrible places in America to have a shooting, and this would make the list for sure," he said.

He said officers are trained to fire only as a last resort and must fire multiple shots because only one in five generally hit the intended target.

He said it was "not a choreographed event where the officers can look at each other and say, 'You fired three? I'll fire two.'"

And sometimes, the officers fail to disable a gunman even when they hit him, O'Donnell said.

Those injured can sue the city for damages for personal injury if they can prove officers did not exercise care reasonably required under similar circumstances. The family of a woman killed by police in 1993 received nearly $4 million.

The woman, Bonnie Vargas, was taken hostage by a gunman fleeing a bank robbery in Manhattan. She was shot three times by police when they exchanged fire with the hostage taker. The appeals court noted that the patrol guide said police in a hostage situation could not fire a weapon "when doing so will unnecessarily endanger innocent persons."

The court also wrote: "The immunity afforded a municipality for its employee's discretionary conduct does not extend to situations where the employee, a police officer, violates acceptable police practice."

O'Donnell said it was likely lawyers will test the adequacy of Friday's police shooting.

"I'm sure there's people chasing the ambulances into the emergency room as we speak," he said.

He predicted the city would undertake a careful study of the events, as well.

"The NYPD will take it seriously," he said. "The cops are authorized by law to defend themselves, but not to be reckless. You've got to be careful you don't unnecessarily endanger other people."

Defense lawyer Ron Kuby noted that bystanders shot in crime-ridden neighborhoods do not usually attract much attention.

Citing reports that the suspect was walking away when police confronted him, he said he and other activists "will wonder if it was the best police strategy to open fire in the most densely populated place on the planet."

For civilians, O'Donnell recommends they find something big and sturdy to hide behind if they hear gunshots.

"Be creative in taking cover," he said. "Always find something to duck behind, a fire hydrant, go into the gutter, in the curb."

He advised against running: "You're not going to outrun a bullet."

An iPod Nano Pocket Watch Crowdfunding on Kickstarter is Designed and Not Just Made in China

While the face-kini is the latest strange Chinese phenomenon, there are designs emerging from China that are not strange but instead, stylish. Two such designs, PodKit Watch? + ClipClok?, are iPod nano? watch accessories currently crowdfunding on Kickstarter.

An American-Taiwanese industrial designer, Simon Kwan, is amongst the coming wave of independent designers and smaller brands that want to change Western consumers? perceptions of Chinese design. With the success of Apple? MacBooks?, iPhones?, and iPods?, all made in China, the quality and perception of Chinese made products is already improving. Designed in China, however, is still a novel idea, with very few Chinese brands, such as Lenovo? and Haier?, and even fewer Chinese designers making inroads into Western markets. Kwan, and others like him, is seeking to change that.

Kwan?s PodKit Watch? is a modern retro mix of a classic gentlemen?s pocket watch and personal electronics accessory. Inspired by the success of LunaTik?, the first Kickstarter design project to raise almost $1 million in crowdfunding, Kwan decided to also use the site to launch his own take on the iPod?-as-watch product trend. His design, however, adds some new twists. Unlike the LunaTik?, PodKit Watch? isn?t worn on the wrist. It comes with two chains allowing it to be either worn on clothing and bags or as a pendant.

Indeed, Kwan hopes his design will appeal better to women, who may not wish to wear a nano wristwatch, which is somewhat ironically bulky on the wrist. Kwan?s design also doesn?t require tools to install or remove the nano. As with classic pocket watches, this one has a spring loaded cover that protects the nano?s touchscreen display. Opening the cover also simultaneously wakes up the nano?s display from its power saving sleep mode. Nano wristwatch owners need to press the nano?s power button using their other hand to do the same.

The ClipClok? is an analog watch, or timepiece module as its designer refers to it, that is shaped just like a nano. It?s meant to be swapped in place of the nano when owners either can?t wear the nano as a watch, like on rainy days or when their nanos need recharging, or when the next generation iPod nano? is introduced, most likely featuring a new shape and size.

Kwan launched his Kickstarter project at the beginning of August, and with a little over a week remaining, has not had as much success as he had hoped in reaching his funding goal. Does this signal that the world isn?t ready for Designed in China? Kwan thinks not.

He instead believes his campaign?s slow funding is due to his lack of PR and marketing savvy. Prior to launching his campaign, Kwan didn?t even have a Twitter account. He has learned quickly and is now active on Twitter, Pinterest, and Google+. It remains to be seen, however, if his actions now are enough for PodKit Watch? + ClipClok? to succeed.

Regardless of the outcome, Kwan says this, his first attempt at crowdfunding, has been an incredible learning experience, ?My backers, friends, and family have been so supportive. I?ve received enough honest compliments about my designs that I feel confident if I fail this first time out, I can re-structure, re-launch, and succeed in the future. I think there are great designs waiting to come from designers in China, and crowdfunding is a fantastic way to both fund them and validate consumer interest.?

Elderly Spanish parishoner accidentally disfigures church's prized Christ fresco

File this one under no good deed goes unpunished.

A small Spanish town is trying to figure out what to do with a 20th-century painting of Christ that has been disfigured by a local artist who took it upon herself to restore it.

Juan Maria Ojeda, an official in Borja town, said 80-year-old Celia Gimenez decided to touch up the fresco of Christ wearing a crown of thorns in the Misericordia church because she thought it need restoration. He said no one realized how badly disfigured the painting was until she rang town hall to say what she had done.

The fate of the painting has made national news in Spain.

The fresco is of the genre known as "Ecce Homo" style ("Behold the Man"). But on Thursday some Twitter users were dubbing it "Ecce Mono" ("Behold the Monkey").

Signs of Skin Cancer: Things To Look For With Skin Cancer

The other day, I was taken by the hair coloring of a clerk at the local store. I commented on how beautiful it was, with the dark base and the natural-looking streaks, as if the sun had touched her alone; and we began a conversation of how when we were younger we would not have to use any hair dyes: we just sprayed SunIn on our hair and laid out in the sun for an hour or two.

This of course led us to discussing the near impossibility of doing that now, as we have blasted the ozone layer(s) so hard we have created a direct line between us and the harsher (more deadly) rays of the sun (and no, SunIn is a pump spray, not an aerosol, so we didn't have to go there with culpability and irony and all). But you probably didn't come here to read regarding hair coloring techniques that are sun-free or chemical free, for that matter at least not specifically. You came looking for information on the different types of skin cancer.

The speculation and theory does hold some evidence against chemicals in a-hem-health and beauty products; and it does point to the sun's 'damaging rays' as a possible cause, etc., but here, since we aren't medical professionals, specialist, or experts, the info on the types of skin cancer is going to be basic and absent of finger-pointing, if you will:

There are three types of skin cancer: Basal Cell Carcinoma (a.k.a. non-melanoma skin cancer); Squamous Cell Carcinoma; and Melanoma. Melanoma (also, Cutaneous Melanoma, Malignant Melanoma) - Cancer cells are growing in the melanocytes, the cells that are responsible for skin pigmentation. According to University of Maryland medicine and other experts, of all of the types of skin cancer, Melanoma is 'the rarest and the most virulent.' It is typically found in people with fair skin, light hair, and/or light eyes, even even however it is possible in others with different complexions, and as the experts above also assert, does not exempt those with dark brown or black skin. Identifiable symptoms include, most commonly, a mole changing color, size, shape, or state (starts oozing or bleeding), or a mole that UMM notes 'feels itchy, hard, lumpy, swollen, or tender to the touch.' Squamous Cell Carcinoma-Also called non-melanoma skin cancer, Squamous Cell Carcinoma usually begins as a red-looking, scaly patch or patches of skin, or can appear as nodules.

Of the three types of skin cancer, Squamous, affecting Caucasians, usually fair-complected, is the second most common and shows up, typically, on the ears (ear-rims), face, lips, and mouth. Basal Cell Carcinoma - The second of the types of skin cancer, Basal Cell Cancer, typically starts as a 'small, fleshy bump or nodule,' most commonly found on the head, neck, and/or hands. Of the three types of skin cancer, Basal Cell Carcinoma, which is typically found in Caucasians, say those at UMM, make up 'more than 90 percent in the U.S.. My mother had the second most common of the types of skin cancer, on her lip, and while we at first teased her that it was herpes, she was smart enough to know it was a 'sun blister' and quick enough to catch it by going to a specialist.

That's the good news, to give you hope when you bemoan the loss of days picnicking, swimming, and 'bathing' under the magnificent sun.

Good diet, proper exercise help protect astronauts? bones

ScienceDaily (Aug. 24, 2012) ? Eating right and exercising hard in space helps protect International Space Station astronauts' bones, a finding that may help solve one of the key problems facing future explorers heading beyond low Earth orbit.

A new study, published in the September 2012 issue of the Journal of Bone and Mineral Research, looked at the mineral density of specific bones as well as the entire skeleton of astronauts who used a new, stronger "weight lifting" machine. Of course, weights don't really "weigh" anything on the space station but resistance machines allow astronauts to get the same kind of workout. The new Advanced Resistive Exercise Device (ARED), installed in 2008, doubles the maximum simulated weight to as much as 600 pounds.

Researchers compared measurements from 2006 until 2008, when astronauts used a less capable workout machine. They found that astronauts using the advanced system came home with more lean muscle and less fat, and kept more of their whole body and regional bone mineral density. Those same astronauts also consumed sufficient calories and vitamin D, among other nutrients. These factors are known to support bone health and likely played a contributing role.

"After 51 years of human spaceflight, these data mark the first significant progress in protecting bone through diet and exercise," said Dr. Scott M. Smith, NASA nutritionist at the agency's Johnson Space Center in Houston and lead author of the publication.

Since the 1990s, resistance exercise has been thought to be a key method of protecting astronauts' bones. Normal, healthy bone constantly breaks down and renews itself, a process called remodeling. As long as these processes are in balance, bone mass and density stay the same. Earlier studies of Russian Mir space station residents found an increased rate of breakdown, but little change in the rate of regrowth, resulting in an overall loss in bone density.

In the new study, astronauts who used the ARED device still had increased bone breakdown, but their bone renewal tended to increase, likely resulting in a better balance in whole bone mineral density.

"The increase in both bone breakdown and formation suggests that the bone is being remodeled, but a key question remains as to whether this remodeled bone is as strong as the bone before flight," said Dr. Jean Sibonga, NASA bone discipline lead at Johnson and coauthor of the study.

Bone density loss in astronauts on long-duration missions has been a major medical concern. In the past, astronauts have lost an average of 1 to 2 percent per month. By comparison, an elderly person, loses about 1 to 2 percent per year.

This study shows that, through proper exercise and nutrition, crew members on long journeys in space can return to Earth with much less loss of bone mineral density. But a key question remains as to whether the bones are as strong as when the astronaut launched into space. For these and other reasons, additional studies to evaluate bone strength before and after flight are currently under way.

Beyond bone strength, further study is needed to figure out the best possible combination of exercise and diet for long-duration crews. One experiment on the space station right now is looking at how different ratios of animal protein and potassium in the diet affect bone health. Another is looking at the benefits of lowering sodium intake. NASA food scientists have reformulated more than 80 space foods to reduce the sodium content.

"Although more research needs to be done in this regard, our study marks a significant milestone in our long search to find ways to help ensure crew health and performance on long-duration missions," said Smith. "These data will be critical in enabling us to send humans, once again, to destinations beyond low Earth orbit."
